Over housing disrepair claims

No win, no fee help for council, housing association and private tenants in Over whose landlord has not carried out repairs.

Your landlord in Over is responsible for the structure of your home, its heating, water, gas and electrics, and for keeping it free from damp and mould. If you have reported a problem and nothing has happened, you could be entitled to repairs and compensation. We deal with your landlord for you, with no win, no fee, so you are never left out of pocket.

Your landlord's repair duties in Over

Tenants in Over sometimes assume that because a repair has been "reported" they have done all they can. In fact, once a landlord knows about a problem they have a legal duty, under the Landlord and Tenant Act 1985 and the Homes (Fitness for Human Habitation) Act 2018, to put it right within a reasonable time. What counts as reasonable depends on the problem: a dangerous electrical fault or total loss of heating in winter should be dealt with in days, not months.

Tenants in Over most often contact us about:

  • Ceiling problems
  • Heating problems
  • Leaking problems
  • Electric problems
  • Wall problems
  • Guttering problems
  • Pest problems
  • Any other defect that affects your health, safety or use of the home

How a housing disrepair claim works in Over

Here is what happens when you ask us to look at a housing disrepair claim in Over.

  1. Free claim check. Tell us what is wrong, when you first reported it and who your landlord is. We will tell you honestly whether you have a claim.
  2. Evidence and inspection. An independent expert visits your home, records every defect and sets out exactly what your landlord needs to do to fix it.
  3. Letter of claim. A formal letter puts the landlord on notice. Most landlords, including councils and housing associations, settle at this stage rather than go to court.
  4. Repairs and compensation. Once agreed, the landlord must complete the works and pay your compensation. If they will not cooperate, we can take the case to court.

Compensation for tenants in Over

There is no fixed tariff, but courts and landlords generally value disrepair claims as a share of your rent for the affected period, commonly 20% to 50%. On top of that you can claim for damaged belongings, extra heating costs and any injury or illness the conditions caused.

For example, a tenant in Over paying £650 a month (£7,800 a year) whose claim is valued at 20% would receive around £1,560 for each year of disrepair, or about £3,120 over 2 years, before adding anything for damaged belongings or ill health. Claims can go back up to six years.

Housing disrepair in Over: frequently asked questions

Can I claim if I have already moved out?

Yes, as long as the disrepair happened within the last six years and you reported it to your landlord at the time. You can claim compensation for the period you lived with the problems even though repairs are no longer needed for you.

Do I have to pay anything?

No. We work on a no win, no fee basis. There is nothing to pay up front, and if the claim is unsuccessful you pay nothing. If the claim succeeds, legal costs are recovered from your landlord and an agreed success fee is deducted from your compensation, which we explain clearly before you sign anything.

Will I be evicted for making a claim in Over?

Secure and assured tenants of councils and housing associations cannot be evicted for making a disrepair claim. Private tenants in England are protected from "retaliatory eviction" where the council has served an improvement notice, and the Renters' Rights reforms have strengthened protection further. We will explain your position before you decide to go ahead.

How long does a housing disrepair claim in Over take?

Many claims settle within six to nine months of the letter of claim. Urgent repairs can often be forced through much sooner, and if your landlord accepts liability early the whole process can be quicker. Cases that go to court take longer, but that is rare.

Does Housing Benefit or Universal Credit affect my claim?

No. Compensation is calculated on the rent charged for the property, whoever pays it. If your rent is paid in full or in part by Housing Benefit or Universal Credit you can still claim, and the compensation is paid to you.
